These Terms of Service ("Terms") govern your use of the Kappa Loop mobile application ("App") operated by Kappa Alpha Psi Fraternity, Inc. ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the App.

Eligibility

Membership Requirement

The App is exclusively for verified members of Kappa Alpha Psi Fraternity, Inc. By using the App, you represent and warrant that:

  • You are a current member of Kappa Alpha Psi Fraternity, Inc.

  • You are at least 18 years of age

  • You have the authority to enter into this agreement

  • All information you provide is accurate and current

Account Verification

  • Your account must be verified before full access is granted

  • You must provide accurate membership information

  • Falsifying membership information may result in account termination

Account Registration and Security

Account Creation

  • You must provide accurate, complete information during registration

  • You must keep your account information up to date

  • You are responsible for maintaining the confidentiality of your password

  • You must notify us immediately of any unauthorized access to your account

Account Responsibilities

  • You are responsible for all activities under your account

  • Do not share your account credentials with others

  • Do not create multiple accounts

  • Do not impersonate another member or entity

Acceptable Use

Permitted Uses

You may use the App to:

  • Access fraternity announcements and information

  • View and RSVP to events

  • Connect with other verified members

  • Update your profile information

  • Receive organizational communications

Prohibited Activities

You may not:

  • Violate any applicable laws or regulations

  • Infringe on intellectual property rights

  • Post false, misleading, or deceptive content

  • Harass, threaten, or harm other members

  • Distribute spam or unsolicited messages

  • Upload viruses, malware, or harmful code

  • Attempt to gain unauthorized access to the App or systems

  • Scrape, data mine, or extract data from the App

  • Reverse engineer or decompile the App

  • Use the App for commercial purposes without authorization

  • Impersonate fraternity officers or administrators

  • Share confidential fraternity information publicly

Content

User-Generated Content

  • You retain ownership of content you create

  • By posting content, you grant us a license to display and distribute it within the App

  • You are responsible for the content you post

  • Content must comply with fraternity standards and values

Content Standards

All content must:

  • Be respectful and professional

  • Align with fraternity values and mission

  • Comply with copyright and trademark laws

  • Not contain offensive, discriminatory, or inappropriate material

  • Not disclose confidential fraternity information

Content Removal

We reserve the right to:

  • Remove content that violates these Terms

  • Suspend or terminate accounts for violations

  • Moderate content at our discretion

  • Take action without prior notice for serious violations

Intellectual Property

Our Rights

  • The App and all content, features, and functionality are owned by Kappa Alpha Psi Fraternity, Inc.

  • Kappa Alpha Psi trademarks, logos, and service marks are protected

  • You may not use fraternity marks without written permission

  • The App is protected by copyright, trademark, and other laws

Limited License

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and use the App for personal, non-commercial purposes

  • View and download content for personal use

  • Use features as intended

This license does not permit:

  • Modification, distribution, or reproduction of the App

  • Commercial use without authorization

  • Removal of copyright or proprietary notices

Privacy and Data Protection

Your use of the App is subject to our Privacy Policy, which explains:

  • What information we collect

  • How we use your information

  • Your privacy rights and controls

  • Data security measures

Communications

Notifications

By using the App, you consent to receive:

  • Push notifications about events and announcements

  • Service-related communications

  • Updates about the App

  • Important organizational messages

Electronic Communications

You agree that all agreements, notices, and communications may be provided electronically through the App.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Uninterrupted or error-free operation

  • Accuracy or reliability of content

No Guarantee

We do not guarantee that:

  • The App will always be available or uninterrupted

  • Defects will be corrected

  • The App is free of viruses or harmful components

  • Results from use will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • WE ARE NOT LIABLE FOR LOSS OF PROFITS, DATA, OR USE

  • OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID (IF ANY) TO USE THE APP

This limitation applies to claims based on:

  • Breach of contract

  • Breach of warranty

  • Negligence

  • Strict liability

  • Any other legal theory

Indemnification

You agree to indemnify, defend, and hold harmless Kappa Alpha Psi Fraternity, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including attorney fees) arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any rights of others

  • Content you post or share

  • Your breach of representations and warranties

Termination

By You

You may terminate your account at any time by:

  • Using the delete account feature in the App

  • Contacting us to request account deletion

By Us

We may suspend or terminate your account if:

  • You violate these Terms

  • Your membership in Kappa Alpha Psi ends

  • We suspect fraudulent or illegal activity

  • Necessary to protect the fraternity or other members

  • Required by law

Effect of Termination

Upon termination:

  • Your right to use the App immediately ceases

  • Your account access is disabled

  • Some content may be retained for organizational purposes

  • Provisions that should survive termination will remain in effect

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

  • Immediately upon posting in the App for material changes with notice

  • After 30 days for non-material changes

Continued use after changes constitutes acceptance. We will notify you of material changes through:

  • In-app notification

  • Email to your registered address

  • Prominent notice in the App

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the United States and the State of [State], without regard to conflict of law principles.

Dispute Resolution

  • Disputes should first be resolved informally by contacting us

  • If informal resolution fails, disputes shall be resolved through binding arbitration

  • Arbitration shall be conducted in accordance with American Arbitration Association rules

  • You waive the right to participate in class action lawsuits

Exceptions

The following are not subject to arbitration:

  • Claims related to intellectual property

  • Claims seeking injunctive relief

  • Small claims court actions

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Severability

If any provision is found unenforceable, the remaining provisions continue in full force and effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign these Terms. We may assign our rights and obligations to any party at any time.

No Agency

No agency, partnership, joint venture, or employment relationship is created by these Terms.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
